INTRODUCTION

    Metropark and Clique ("Clique"), a business unit of Sparkart LLC, may provide you with various opportunities to make purchases through the Metropark online store Web site and Clique Services. These Purchasing Terms describes the rules and policies associated with purchases made on or for the Metropark online store Web site and Clique Services. By using the Metropark online store Web site and Clique Services, you agree to the terms contained in these Purchasing Terms.

    PAYMENTS

    Advanced payment in full by credit card is required for all orders. Metropark will accept payment via MasterCard, Visa or Discover. Metropark does NOT accept payment by PayPal or mail-in payments. Please do not send cash, money orders, cashier's checks or personal checks. All prices are subject to change from time to time at Metropark's sole discretion. Price changes will be posted.

    ORDER PROCESSING

    Most in-stock orders are processed and shipped within one to two business days.

    To ensure that orders are shipped within this timeframe, orders are processed as soon as they are received. Orders cannot be cancelled, changed or combined once they have been processed.

    REFUNDS, RETURNS AND EXCHANGES

    Here at Metropark we want to make sure that you are completely satisfied with the purchases that you have made. With that in mind, purchases made online may be returned or exchanged at Metroparkusa.com or any Metropark location within 21 days of the original purchase date. Items must be in their original condition, unworn, unwashed, have the tags attached and be accompanied with the original invoice. Refunds will be credited in the original form of payment used when the order was placed. Items purchased within a Metropark store may only be returned at a Metropark store. Do not send items purchased in Metropark stores back to us. Items that do not comply with the above policy will not be accepted for return or exchange. If you do ship such items, Metropark will not be responsible for processing and returning such items. When returning an item at a Metropark store, you must provide the credit card originally used to make the purchase as well as the original invoice. If you do not have the original credit card we will be unable to complete the return. If you do not have the original invoice we will not be able to complete the return.

    Please Note: The following items are not eligible for return: Artwork, Jewelry, Lingerie, Media (CDs, DVDs, etc.), and Swimwear.

    Please ensure that the shipping address you provide during the checkout procedure is accurate and complete before placing your order. To ensure that orders are shipped as promptly as possible, orders are processed as soon as they are received. Your shipping address cannot be changed once your order has been processed.

    Metropark will not refund any customer whose order is not received because the shipping address provided during the checkout procedure was inaccurate or incomplete unless that order is classified as undeliverable and returned to Metropark (see Undeliverable Packages for details). Metropark will not re-ship any order that is not received because the shipping address provided during the checkout procedure was inaccurate or incomplete.

    SHIPPING

    Please note: On U.S. holidays, order processing and/or shipping may be slightly delayed. Metropark is not responsible for lost packages if you did not properly submit the correct shipping address with your order.

    Domestic Shipping: All packages are shipped within 1 to 2 business days where available. All orders over $300 may require a signature upon delivery. Shipping charges are determined by the number and weight of items ordered and the shipping method selected. Shipping time frame for each shipping method is estimated. The typical delivery timeframe is 3-5 business days for ground packages. Metropark does offer expedited shipping for Two day and Next Day deliveries.

    International Shipping: MetroparkUSA.com has partnered with a trusted third-party company, International Checkout, to fulfill orders for our International customers.

    With a normal customs clearance, these are the estimated transit times for standard and priority shipments:

    STANDARD: Please allow at least 4-12 business days, providing the store has the item(s) in stock and available for immediate shipment, for your order to arrive at our depot. We are not responsible for delays by the store in the shipment of your item to our depot. The transit time from the store to our depot depends on where in the USA the store you purchased from is located. We ship your merchandise as soon as it arrives at our depot and provide you with a tracking number. Allow 4-8 business days for your order to arrive in your country from the day we ship it to you.

    PRIORITY: Please allow 2-4 business days, providing the store has the item(s) in stock and available for immediate shipment, for your order to arrive at our depot. We are not responsible for delays by the store in the shipment of your item to our depot. The transit time from the store to our depot depends on where in the USA the store you purchased from is located. We ship your merchandise as soon as it arrives at our depot and provide you with a tracking number. Allow 2-4 business days for your order to arrive in your country from the day we ship it to you.

    CUSTOM ORDERS / PRE-ORDERS

    From time to time custom ordered items may be offered for purchase prior to availability to ship. If you choose to pre-purchase the specified item(s) by adding to your bag and completing the checkout process, your credit card will be charged at the time of purchase. If, at the time of purchase, other items were in stock that you ordered, these items will be shipped immediately per standard shipping policies. Once the custom ordered/pre-ordered item is in stock your item will be shipped. The scheduled ship date is not a guarantee. All pre-ordered items will be shipped via ground shipping. This policy applies to both domestic and international orders.

    BACKORDERS

    If all of the items included in your order are out of stock, we will notify you via e-mail that your order has been cancelled due to lack of inventory and you will be issued a full refund of your order total (including tax, gift wrap, and shipping and handling).

    If some, but not all, of the items included in your order are out of stock, we will ship only the items that are available in stock. You will be charged sales tax for only those items available in stock that will be shipped.

    UNDELIVERABLE PACKAGES

    If for any reason your order is classified as undeliverable and returned to Metropark, we will notify you via e-mail that your order has been cancelled due to a failed delivery attempt and you will be issued a refund of your order subtotal. Shipping and handling will not be refunded.

    Metropark will not re-ship any order that is classified as undeliverable and returned to us. If you would still like to purchase the items that were undeliverable, please place a new order through our website.

    STATE SALES TAX

    In accordance with state laws, we are required to charge sales tax on orders shipped within the continental US. Sales tax is applied to the total amount of the order, which includes gift wrap, shipping and handling charges and is based on the shipment's destination state and local sales tax rates.

    For your planning and convenience, we display exact sales tax amount when orders are placed and reflects all state and local taxes of your order destination at the time your order is placed.

Continued access to or use of the Metropark online store Web site and Clique Services after any such change shall constitute your consent to such change.
